Ollura — Effective as of July 21, 2026

Welcome to Ollura. These Terms of Service ("Terms") set the rules for accessing and using shopollura.com (the "Site") and any products bought through it (together, the "Services"). By browsing or using the Site, you're agreeing to these Terms. If you don't agree, please don't use the Site.

1. About Ollura

Ollura is an online retailer selling physical products through shopollura.com. These Terms apply to everyone who visits, shops on, or otherwise uses the Site.

2. Who Can Use the Site

There's no set age requirement just to browse. But placing an order means you're confirming you're legally able to enter into a binding agreement, or that a parent or guardian has approved the purchase if you're not. You're responsible for making sure your use of the Site follows the laws where you live.

3. Accounts and Orders

You don't need an account to shop with us — every order goes through as a guest checkout. It's on you to make sure the information you enter (shipping address, contact details, payment info) is accurate, current, and complete. Ollura isn't liable for delivery problems caused by incorrect details entered at checkout.

4. Products and Pricing

Product descriptions, photos, and prices can change at any time without warning. We try hard to represent colors, sizes, and other details accurately, but we can't promise that every piece of content is fully accurate, current, or free of mistakes.

If a pricing error occurs, Ollura may cancel any order placed at that incorrect price, confirmed or not.

We also reserve the right to cap quantities, decline service, or cancel orders at our discretion — including when we suspect fraud or spot a pricing or listing error.

5. Payment

Full payment is required at the time of purchase, using one of the methods offered at checkout. By submitting payment details, you're confirming you're authorized to use that payment method.

6. Shipping

Shipping costs and estimated timelines appear at checkout. Ollura isn't responsible for delays caused by carriers, customs, weather, or other factors outside our reasonable control. Once an item is handed off to the shipping carrier, risk of loss and title transfer to you, except where local law says otherwise.

7. Returns and Refunds

Returns and refunds are handled under our separate Return and Refund Policy, posted at shopollura.com, which is incorporated here by reference.

8. Intellectual Property

Everything on the Site — text, graphics, logos, images, software — belongs to Ollura or our licensors and is protected under applicable IP law. You can't copy, distribute, modify, or build derivative works from any of it without our written go-ahead.

9. Rules of Use

You agree not to:

- Use the Site for anything unlawful or in breach of these Terms
- Try to gain unauthorized access to any part of the Site or its systems
- Interfere with or disrupt how the Site operates
- Use bots, scrapers, or other automated tools to access the Site without our permission
- Submit false or misleading information when placing an order

We may suspend or terminate access for anyone who breaks these rules.

10. No Warranties

The Site and its products are offered "as is" and "as available." To the extent the law allows, Ollura disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the Site will run uninterrupted, securely, or error-free.

11. Limits on Liability

To the extent permitted by law, Ollura and its officers, employees, and affiliates won't be liable for indirect, incidental, special, consequential, or punitive damages tied to your use of the Site or its products, even if we were warned such damages were possible. Our total liability for any claim under these Terms is capped at the amount you paid for the product(s) involved in the claim.

12. Indemnification

You agree to cover and hold harmless Ollura, its officers, employees, and affiliates from any claims, damages, losses, or costs (including reasonable legal fees) arising from your use of the Site, your breach of these Terms, or your violation of someone else's rights.

13. Dispute Resolution — Binding Arbitration

Please read this section closely — it affects your legal rights.

Any dispute, claim, or disagreement arising from these Terms, your use of the Site, or products you've purchased (a "Dispute") will be settled through binding arbitration rather than in court, except that either side may bring an individual claim in small claims court where eligible.

- Arbitration will be run by a recognized arbitration body (such as the American Arbitration Association) under its standard rules.
- It will take place in the county where Ollura's principal place of business sits in Kentucky, at another location both parties agree to, or remotely/by written submission where allowed.
- Class Action Waiver: You and Ollura agree that any Dispute will be handled individually, not as part of a class, collective, or representative action. You're waiving any right to join a class action lawsuit or class-wide arbitration.
- This arbitration clause doesn't stop either side from seeking injunctive or equitable relief for disputes involving intellectual property infringement or unauthorized access to the Site.

14. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky and relevant U.S. federal law, without regard to conflict-of-law rules.

15. Updates to These Terms

We may revise these Terms periodically. Updates will be posted here with a new "Effective Date." Continuing to use the Site after changes go live means you accept the updated Terms.

16. Severability

If any part of these Terms is found unenforceable or invalid, that part will be narrowed or removed only as much as needed, and the rest will stay in effect.
